To qualify for 2nd Preference, aliens have to have PERM cases filed for occupations classified as Zone 4 or Zone 5 on the O*Net.
Zone four allows 2-4 years of Specific Vocational Training. This means, that if you require a Master's Degree, and the occupation corresponds to Zone 4, you can not require any experience in the job offer without exceeding SVP. If you exceed SVP, you will be audited and you need to show business necessity.
Zone 5 allows up to to 10 years SVP, which means that the job opportunity can require a graduate level degree plus years of experience.
My colleague Jose Canepa in Queens, NY, agreed to share a copy of the complete list of Zone 5 occupations which his office uses, along with examples of prevailing wage determinations. There are numerous interesting observations to be made. Mr. Canepa's list is taken for O*Net occupations and prevailing wages in the Metropolitan New York area, covering New York, White Plains, and parts of New Jersey.
While most of the jobs are phyicians, teachers, scientists and scholars, there are some jobs that may be business related, and therefore could be used in a large number of business settings.
