Politico reports on a McCain interview with CNN. The other interesting takeaway is McCain's indication that he'll stand firm in insisting on a guest worker program in the comprehensive immigration reform bill if he's going to work for its passage. I hope he's successful in that effort. Without addressing the future flow of immigrant workers, we'll be debating another legalization bill in ten or fifteen years.
Posted at 10:08 AM | Permalink | Comments (6) | TrackBack (0) AP: DOBBS BECOMING PUBLICITY NIGHTMARE FOR CNN Here's another article discussing the embarrassment that is CNN's Lou Dobbs Tonight. I don't need to elaborate on that, but the more interesting part of this article is a discussion of why CNN is so reluctant to fire him. Apparently, it's more fear of Dobbs going to Fox and worry about Dobbs using his radio show to bash CNN. But is this really so valid? Dobbs' ratings are down 20% this year. Fired anchors jump networks all the time. Some do better at their new digs. Others fade in to further obscurity. And CNN is bashed daily both on Fox (and MSNBC) and on talk radio all the time anyway. CNN is trying to foster a reputation as the only one of the three news networks that does not lean left or right. Dobbs' show detracts from that effort every day it remains on the air. Here's the press release:
Siskind Susser Immigration Lawyers attorneys Mikiel Davids and Karen Weinstock of the Atlanta office recently won a landmark case in the U.S. District Court in the Northern District of Georgia against the U.S. Department of Labor. The court ordered DOL to immediately decide a pending PERM application (foreign labor certification) after finding the agency had unreasonably delayed in doing so. Our attorneys brought the case to federal court in order to ensure that the I-140 immigrant petition for their client could be filed with USCIS before the client’s son turned 21, after which point he would no longer be eligible to obtain a green card with the rest of his family. But the I-140 petition could not be filed until DOL decided the labor certification and the agency refused to expedite a decision on the pending PERM application on the basis of the plaintiff’s son’s “ageing out,” or for any reason, including the fact that the application had been pending 4 months beyond DOL’s stated processing times. To the knowledge of the Plaintiff’s attorneys, the victory secured in this case, Kumykov v. Carlson et al., is the first time that a court has ordered DOL to decide a permanent, foreign labor certification by a court imposed deadline. DOL complied with the court’s Order and approved the labor certification prior to the 21st birthday of the plaintiff’s son, allowing attorneys Karen Weinstock and Mikiel Davids to file the I-140 petition with USCIS in time to preserve the family’s ability to immigrate all together, thus preventing irreparable harm to the applicant and his family. ILRC ISSUES RECOMMENDATIONS FOR A LEGALIZATION PROGRAM
The folks at the Immigrant Legal Resource Center have come up with a list of recommendations for legislators as they craft a legalization plan in the upcoming comprehensive immigration reform debate:
6. Requirement of English Proficiency and Civic Integration: This recommendation is designed to promote integration of immigrants by requiring English language acquisition, including for those for whom this is difficult because of lack of education or advanced age. For a new legalization program we recommend that the applicant be able to fulfill the basic English language requirement by showing that they are "satisfactorily pursuing a course of study (recognized by the Department of Homeland Security) to achieve such an understanding of English…" if they cannot already demonstrate proficiency in English. (The italicized portion is an excerpt from our suggested statutory language, which we adopted virtually intact from similar language in the 1986 IRCA legalization program. Without such a provision, probably at least one to two million otherwise eligible persons will not be able to qualify for legalization because of failure to achieve the required level of English proficiency. This alternative way of satisfying the English (and civics) requirement by taking recognized courses will promote use of the English language as well as civic integration. Opponents of health care reform efforts have accused the President and
Democrats in Congress of including millions of illegally present
immigrants in proposals to expand health insurance coverage.
Whether one thinks that including such individuals is good or bad, the fact is that only lawfully present immigrants will be eligible for inclusion in the various proposals being considered in Congress. Think Progress explains in a piece refuting erroneous reporting on Lou Dobbs show (surprised?). When you hear figures like 97% of people will be covered under the broadest plans, the 3% they're talking about leaving out are undocumented immigrants. When Jim DeMint, the oh-so-conservative Senator from South Carolina, says that the Obama birth certificate isn't an issue, and when electronic copies of the birth certificate have been produced--and certified--by the state of Hawaii, one wonders why Dobbs keeps flogging this...and why CNN allows him to do it. I don't know if this represents any sort of trend, but unfortunately the field has always had problems with corrupt practices. Desperate individuals and the profit motive are sometimes a recipe for problems. Consumers and the immigration bar need to be vigilant in rooting out problem practitioners and the government needs to be equally diligent in pursuing those in its own ranks who would seek to profit from their positions of authority. [Update: One additional attorney case is the subject of an ICE press release from last week. A Columbus, Ohio lawyer has been arrested for engaging in marriage fraud. YOU'RE GOING TO LOVE DEPENDING ON IMPORTED FOOD The antis will tell you that if we could only get rid of cheap foreign workers, Americans would be lining up to take the jobs. An article this past week in the Wall Street Journal shows a different reality. The piece focuses on the dairy industry which is completely dependent on immigrant labor even in a major recession. And dairy is pretty similar to other agricultural fields. US workers are simply not desperate enough to take on these physically demanding jobs in remote rural locations. The antis response is usually the same - if these employers just paid more, then US workers would take the positions. And to some degree that's true. The problem is that it assumes that US farmers have the ability to absorb that expense either by cutting profits or raising prices. Unfortunately, there is another option on the table - importing the food in order to keep costs low for consumers. No doubt antis would suggest throwing up trade barriers to stop this, but that will drive up the costs for Americans to feed themselves - something that will be a non-starter. If you think depending on other countries to meet our energy needs puts the US in a vulnerable position, it's hard to see how depending on other countries just to eat could be much better. Posted at 09:05 PM | Permalink | Comments (3) | TrackBack (0) SENATORS INTRODUCE BILL TO REFORM IMMIGRATION DETENTION STANDARDS Senators Menendez (D-NJ), Kennedy (D-MA) and Gillibrand (D-NY) have introduced a pair of bills designed to address major problems in the immigration detention system. The ACLU describes the twin pieces of legislation: Senator Robert Menendez (D-NJ) today introduced two bills crucial to fixing major problems with U.S. immigration detention policy. The “Protect Citizens from Unlawful Detention Act,” would protect U.S. citizens and lawful permanent residents from being unlawfully detained and deported by the Department of Homeland Security (DHS) and require the Department’s Immigration and Customs Enforcement (ICE) agents to follow due process standards in executing immigration enforcement actions. The “Strong STANDARDS Act,” would aim to prevent deaths of immigration detainees by requiring DHS to issue detention regulations that are legally binding and enforceable. On a related note, a new study reports that ICE has not been meeting its own standards at detention centers around the country. MEDIA MATTERS LAUNCHES CAMPAIGN TO SANCTION DOBBS
Media Matters has created a web site entited Dobbsconpiracy.com and is urging the public to send letters from the site to CNN president Joel Klein to complain about Dobbs' latest controversy - his questioning of the immigration status of President Obama. The Media Matters folks say that more than 15,000 letters have been sent via the site.
Posted at 08:56 PM | Permalink | Comments (7) | TrackBack (0) SENATE COMMITTEE VOTES TO REPLACE REAL ID LAW The Senate Homeland Security and Governmental Affairs Committee voted today to scrap the controversial REAL ID law which will require states to begin implementing tough new standardized technology requirements for drivers licenses in just a few months. A number of states have rebelled against the requirements and they risk their licenses not being accepted for federal purposes - including boarding airplanes. The measure that passed today is called the PASS ID bill and would extend deadlines and provide more government funds to help in the transition. From Govexec:
