To delay any legal effect or implementation of a notice of rights and request for disposition form of the Immigration and Naturalization Service if an alien admits to being in the United States illegally, gives up the right to a hearing before departure, and requests to return to his country without a hearing.

Mr. LATOURETTE introduced the following bill; which was referred to the Committee on the Judiciary


A BILL

To delay any legal effect or implementation of a notice of rights and request for disposition form of the Immigration and Naturalization Service if an alien admits to being in the United States illegally, gives up the right to a hearing before departure, and requests to return to his country without a hearing.

    Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. DELAY IN LEGAL EFFECT OR IMPLEMENTATION OF NOTICE OF RIGHTS AND REQUEST FOR DISPOSITION FORM OF THE IMMIGRATION AND NATURALIZATION SERVICE IN CERTAIN CASES.

    In any case in which an alien executes a notice of rights and request for disposition form of the Immigration and Naturalization Service admitting to being in the United States illegally, giving up the right to a hearing before departure, and requesting to return to the alien's country without a hearing, such form shall not be legally binding on the alien and no departure or return may be implemented--

      (1) unless the form was certified after the alien consulted with an attorney or other legal representative regarding the alien's legal rights in the United States and such consultation was conducted in the native language of the alien or with the assistance of an interpreter; or

      (2) until 72 hours after the time of certification of the form.
