A Note from the Editors:

The Commissioner of the INS has addressed personally the case of a British widow who feared removal after losing her husband in the WTC attack. In a news release INS Commissioner James Ziglar stated that families of victims of the terrorist attacks at the WTC and Pentagon whose immigrant or nonimmigrant status was dependent on the victim's status should not be concerned about facing immediate removal. He referred specifically to the recent reports of a British woman widowed by the WTC attack, noting that she was not facing removal. According to an Associated Press article in the Newark Star Ledger, INS spokesman Russ Bergeron also said the INS is committed to finding a solution for the woman. Commissioner Ziglar emphasized that the case was one of unfortunate timing. A petition for change of status for her husband from H-1B to O had been filed with the Vermont Service Center in July. On September 13, unaware that he was missing in the WTC attack, the Service Center mailed a routine letter to the husband's attorney requesting information about the beneficiary's eligibility for O status. When the INS was made aware of the situation, it immediately exercised its discretion and granted deferred action for humanitarian reasons. When she met with INS officials on September 27 the widow was informed that she was not facing removal, and was offered deferred action which would allow her to remain in the US and receive work authorization.

The controversy was kicked up when telegraph.co.uk carried the article 'US May Expel Briton Widowed by bin Laden'.

In addition to offering legislation empowering South Carolina law enforcement officers to makes arrests for criminal violations of the federal immigration laws, the Attorney General said that his office is currently in preliminary discussions with the INS to reach an agreement allowing South Carolina law enforcement officers to be deputized as INS agents for full enforcement of the federal immigration laws.

Editor's Note: the following are in response to an article in the telegraph.co.uk to which Immigration Daily carried a link.

Dear Editor:

I could not believe what I was reading in the article about Deena Gilbey, of the UK and now of Chatham, NJ. I have heard repeated news stating that the government would be making adjustments in the cases of those hurt or killed in the attacks on 9/11. Apparently, nobody told the Newark office.

As a US citizen living in New Jersey, I have done what I can - I've e-mailed both Senators (Torricelli and Corzine) asking them to create a private bill for Mrs. Gilbey giving her permanent residency or citizenship, whichever she wants. I also support the Chatham police chief in his stance.

Let's hope that saner heads prevail and also that whoever made the decision to send her such a letter be firmly disciplined.

Yesterday's article about the British woman whose husband's tragic demise in the WTC Terror incident and subsequent INS removal proceedings against her despite political assurance to the contrary once again only underscores, the inhumane, pitiful and narrow minded, bureaucratic mind set of INS personnel as the most inefficient federal agency of all times.
