A Note from the Editors:

Recently we have received a few letters addressed to the editor along the lines of, "Thank you for providing this useful service. I need to file a petition for..." or "I filed my petition ages ago...." Unfortunately we cannot offer advice in specific cases. The first reason is lack of resources. The editorial staff to research, write and publish the Daily consists of one person. The second reason is one of having a sound business model. We are not a law firm and do not provide legal services. Our customers are the attorneys who become members of the site, and use our Case Tracking and IFillForms software.

We continue to provide at no cost all the primary source immigration law material available, as well as articles and letters about all aspects of immigration law. Visitors who need help with their individual cases may use this material to educate themselves, and make sure time spent with a lawyer is used efficiently. To find a lawyer for your case you can use the Directory of Attorneys. You can also ask a question in chat with lawyers, or post your query on the discussion board. We continue to welcome letters on all aspects of immigration law and policy at weeklyeditor@ilw.com.

The most popular articles in the month of December 2001 were:

  1. Never Say "i" (Unless You Must): Employment-Based Options for Adjustment of Status that Avoid INA § 245(i) by Angelo A. Paparelli and John C. Valdez
  2. I Lost My H-1B Job...What Now? by Steven Riznyk
  3. Tips for Traveling in Uncertain Times by Ellen H. Badger
  4. 180 Day Portability Rule: Clearing Up Common Misconceptions by Carl Shusterman
  5. Practical Tips for Noncitizens in a Post-September 11 World by Cyrus D. Mehta, and
  6. The ABCs of Immigration - Consular Processing for Nonimmigrant Visas by Greg Siskind and Amy Ballentine

Also very popular was the schedule of new INS fees.

Articles

Never Say "i" (Unless You Must): Employment-Based Options for Adjustment of Status that Avoid INA § 245(i) (Finale)
In the final installment of this article Angelo A. Paparelli and John C. Valdez, discuss section 245(k) and offer their conclusions.

Third Circuit Court of Appeals Holds Mandatory Detention Unconstitutional
Parastou Hassouri of the law offices of Cyrus D. Mehta writes about the Third Circuit's recent decision in Patel v. Zemski, No. 01-2398 (3rd Cir. Dec. 19, 2001).

Immigration
According to Time.com, it's hardly news that foreign nationals have long been slipping across the border with bogus papers, and visitors who arrive in the US legitimately often overstay their legal welcomes with impunity, but since September 11 this laxness toward immigration fraud may be about to change.

The Year Ahead: What 2002 will bring for Immigration
Gary Endelman writes about the forces which will shape the field of immigration law in the coming year.

Text of Mayor Giuliani's Farewell Address
In his farewell address as carried in the New York Times [registration required], ex-mayor of New York City Rudolph Giuliani noted that "the key to our success as a city, the reason we are the most famous city in the world, and the reason why we really legitimately are the capital of the world, is really just one thing: immigration."

Tyson Indictments Expose Flaws in US Immigration System
Greg Siskind and Amy Ballentine commenting on the recent indictment of Tyson foods, note that, "if the charges are true, Tyson certainly crossed the line by actually smuggling immigrants into the country. But the Congress shares the blame for failing to create a system that allows employers facing worker shortages to recruit foreign workers."

Visa Revocation of Student from Pakistan Called Unfair
The Las Vegas Sun reports on the case of a Pakistani student with a valid visa denied admission because his sister had overstayed her authorized period of stay.

Letters to Editor

To write to Editors, send emails to weeklyeditor@ilw.com.

Dear Editor:

I would like to respond to Mr. Doan's views, which are obviously in defense of our President's misguided and absolute disregard for our constitutional rights. My response is this, wake up and smell the coffee. We cannot let our patriotism blind us from preserving the sacred institutions which our constitution was founded upon. It is our duty as citizens to provide a check upon our government to ensure that our freedoms will be preserved for generations to come. When we allow our freedoms to be destroyed at the whim of an obviously abritrary President with a single stroke of his pen, we dishonor all those that have fought and died to preserve those freedoms. We are all immigrants at some point or another, and some of us choose to forget.

Dear Editor:

Happy New Year! For past 1 1/2 years we have entered and studied your Newsletter on a daily/weekly basis. As immigrants we found all the important immigration updated laws, jurisprudence, and finally filed under 245(i) for our 2 children who entered EWI and are now in the process for being citizens. All of that we owe to the ILW site. Your very important newsletter provided extremely valuable information, and information is all we needed to get our family on track here in America. Thanks, keep it up.

Dear Editor:

Will there be amnesty in 2002? I believe so. How? First, the government can not ignore those that have been here for many years with strong family and community ties. Second, the government is understanding that not knowing who is here, why, how, since when, and what they were doing before arriving in the US, will not help us to keep track of people. We can not afford to find 10 million people on the streets of the US, because most of them are working to keep our country going, but we can make them come to us! Those that do not show up to be identified and legalized, if qualified to be so, after the deadline period, will be considered WANTED for questioning. That will open the door for a national ID system and the right to stop anyone on the streets (blond or not) and ask for identification as it is being done in certain European countries. Those that do not show up, probably did not come here to work hard, pay their taxes and be integrated to the American society. Time will tell !

Regards,

Charles Schwartz

Immigrant Life

Are you on H-1B visa and have recently been laid off?

Ran says, "I was laid off after having my family come up and settling into schools and we suddenly had to adapt to our new situation. We are currently handling our own business and have since made a change of status to a new visa in order to keep our ability to stay. It isn't the end of the world unless you don't do anything to remedy your own particular case." Read on.
