Social Security Number Delays

The Social Security Administration will not issue a Social Security Number (SSN) to any alien for whom it cannot confirm his identity and immigration status from the USCIS, effective September 30, 2002. According a recent statement from the IRS, no federal law exists which prohibits the hiring of a person based solely on the fact that the person does not have a SSN or prohibits the making of a payment to a person based solely on the fact that the person does not have an SSN.

If you are eligible to work but have not yet received a SSN from the Social Security Administration, the IRS will also not issue an ITIN (Individual Taxpayer Identification Number) to you. To avoid having to pay penalties to the IRS for failing to provide a TIN on your tax return, the IRS suggests that the alien/payor keep documentation to show that his failure to provide a TIN was caused solely by the SSA's new procedures for issuing SSN's to aliens.
