9th Circuit Says Visa Waiver Program Entrant Has AOS Guarantees
In Freeman v. Gonzales, No. 04-35797 (9th Cir. Apr. 21, 2006), the court said that "We conclude, through our review of the language, structure, purpose and application of the statute, that Congress clearly intended an alien widow whose citizen spouse has filed the necessary forms to be and to remain an immediate relative (spouse) for purposes of 1151(b)(2)(A)(i), even if the citizen spouse dies within two years of the marriage." The court further said that "once a VWP entrant files an adjustment of status application as an immediate relative, as contemplated by 8 USC 1255(c)(4), the alien is entitled to the procedural guarantees of the adjustment of status regime."
