BIA cases on the non-LPR exceptional and extremely unusual hardship standard: Matter of Monreal, 23 I & N Dec. 56 (BIA 2001); Matter of Recinas, 23 I & N Dec. 467 (BIA 2002); Matter of Andazola, 23 I & N Dec. 319 (BIA 2002) Massachusetts Supreme Judicial Court case holding that Padilla did not announce a "new rule" under Massachusetts law and, as such, applies retroactively to MA state law convictions which were final after April 1st, 1997: Commonwealth v.
