Question:
An employee has an H1B visa valid until June 2002. He also has an
adjustment pending, and received an advance parole in April 2001. He
travels using the advance parole to reenter the US in Feb 2002. He now
wants to travel again in April, but did not apply for an extension of his
advance parole, which will expire in April 2002 before his planned trip.
Having used the advance parole, can he now travel using his H1B?
Answer by Tammy Fox-Isicoff:
He can travel using his H-1B as long as he will maintain H-1B status and
will not work for any employer other than the H-1B employer.
