Question:

In California, can you request an amendment on the 750B after the Labor Cert has been certified, before filing the I-140? We have a case where the alien's prior experience is incorrect and needs to be changed. Any input will be greatly appreciated.

Answer by Ester Greenfield:

I don't believe that an ETA 750B can be amended after certification. If there is an error on the B form, perhaps you can submit a statement explaining the error with the I-140. But I understand that the CSC is very strict with I-140s and this could be a hard sell.
