Question:

I am an immigration attorney and have been actively involved in processing Haitians in the TPS program. I have been listening to the ILW.com February 24, 2010 Haiti-tps telephone seminar in which you participated. As you may recall you stated with respect to question 16 on the I-765 that the correct desigination is "c(19)." (13.56 time on the CD) I am not trying to argue with and only want to do what is right. The way I read the i-765 instructions, a(12) should instead be used for the initial application; c(19) should be used for the renewal or not applying for work. I would appreciate your clarifying this. I have sent several applications in with the a(12) desigination as I have read elsewhere from the government, I believe, that the a(12) desigination is correct.

Answer from USCIS representatives:

a(12) is correct in this instance. Please refer to page two of: www.ilw.com/seminars/Haiti_citation2a.pdf.
